Terms of Service, Privacy Policy, User Agreements and Disclosures
This combined legal agreement governs your use of the Cubitflow Messaging and Cryptocurrency Platform. It sets the rules for your account, privacy, messaging, wallet usage, platform communications, assumption of risk, liability limitations, and your agreement that wallet custody, security, and transaction responsibility remain with you.
Terms of Service: Acceptance and Scope
This combined legal document forms a binding agreement between you and the Cubitflow Messaging and Cryptocurrency Platform, referred to in this document as The Platform, regarding your access to and use of Cubitflow, including the website, applications, messaging features, wallet tools, notifications, account systems, software interfaces, and related services we make available.
This page includes and combines the Terms of Service, Privacy Policy, User Agreements, and Disclosures for The Platform. By accessing, using, creating an account for, or continuing to use Cubitflow, you confirm that you have read, understood, and agreed to all of the terms on this page. If you do not agree, you must not access or use Cubitflow.
The Platform operates in Canada, but your use of Cubitflow may also be subject to the laws of the United States and any other laws, rules, and regulations that apply in the jurisdiction where you access or use the service. You are solely responsible for ensuring that your use is lawful where you are located and where you direct communications or transactions.
Eligibility and Account Conditions
You may use Cubitflow only if you are legally capable of entering into a binding agreement, meet the age threshold required under our product rules and applicable law, and can lawfully use messaging tools, wallet tools, and related digital services in your jurisdiction.
You must provide truthful, current, and complete account information. You must maintain the accuracy of your account details, including your email address and profile information, and you must not impersonate any person, organization, or affiliation.
The Platform may refuse access, suspend an account, restrict features, or terminate access where we reasonably believe these eligibility requirements are not met, information is false or misleading, or your use creates legal, security, operational, or reputational risk.
Account, Device, and Wallet Security
You are solely responsible for maintaining the confidentiality and security of your devices, login credentials, recovery codes, authenticator app access, vault password, recovery phrase, private keys, backups, email account, and any other tools used to access Cubitflow or any wallet functionality associated with your use of The Platform. You are responsible for all activity that occurs through your account, device, or wallet environment unless applicable law clearly provides otherwise.
You must use reasonable safeguards to protect your account and wallet environment, including maintaining current device security, protecting your email account, storing recovery material securely, keeping backups, and promptly signing out or locking your device where appropriate. If you suspect unauthorized access, compromise, disclosure, phishing, or device loss, you must act immediately. The burden of maintaining secure custody and secure operational practices remains entirely with you.
The Platform, its developers, and its contributors do not accept responsibility or blame for losses or harms caused by your failure to maintain proper security over your account, device, recovery material, credentials, email account, wallet setup, or backups.
Messaging, Groups, Public Spaces, and User Content
Cubitflow provides tools for direct messages, group conversations, group invites, requests, public group participation, and browser-based notifications. You are solely responsible for the content you create, send, publish, or make available through these features.
Public groups and other shared spaces may expose your username, activity, content, and interaction patterns to other users. You are fully responsible for deciding what you disclose, with whom you share it, and whether participation in a public or semi-public space is appropriate for your own privacy and safety needs.
The Platform is not responsible for how other users use, interpret, copy, share, retain, or misuse information you disclose through Cubitflow. We do not guarantee the confidentiality, accuracy, permanence, deletion, or limited circulation of user-generated content, especially in public or semi-public spaces.
Privacy Policy: Information, Use, Retention, and Disclosure
The Platform may collect, use, store, and disclose information you provide directly or generate through use of Cubitflow, including account information, profile information, authentication and session records, security settings, message and conversation data, invite and request status, browser-notification preferences, wallet-related metadata, technical device or browser context, and service interaction records reasonably necessary to operate, secure, maintain, improve, and enforce the service.
In current product operation, this commonly includes your first name, last name, date of birth, username, email address, selected country and province or state, legal-acceptance state, verified-session state, MFA-related status, conversation participation and message history, push-subscription state, wallet account metadata, wallet transaction records stored by The Platform, and limited service telemetry or browser context needed to keep the product working reliably.
We may use information to create and maintain accounts, authenticate users, deliver service functionality, operate messaging and wallet interfaces, deliver platform, account, security, and legal notices, detect misuse, protect the integrity of The Platform, comply with legal obligations, preserve evidence, investigate abuse, and improve reliability and supportability.
We may disclose information when reasonably necessary to operate The Platform, provide services through infrastructure or service providers, deliver emails or notifications, respond to lawful process, enforce this legal agreement, protect users, protect our systems, or preserve rights, safety, and operational integrity. We may retain information for as long as reasonably necessary for these purposes. Where account access is ended or a privacy request is fulfilled, The Platform may make information practically inaccessible and irreversibly anonymized where full deletion cannot be guaranteed across active systems, retained records, processor environments, or backup windows. We do not promise immediate deletion, full recoverability, or absolute irrecoverability of all data at every point in time.
The Platform currently relies on infrastructure and service providers that may process information on our behalf or as part of core platform operation, including Supabase for authentication and database services, Upstash for server-side session state, Vercel for hosting and lightweight analytics, and Brevo for transactional and security email delivery.
Authenticated users may currently use the in-product settings surface to request correction of supported profile fields, download an account-data export reflecting the records The Platform stores, and request irreversible anonymization plus access revocation. These request paths may still be subject to authentication, verification, rate limits, legal constraints, processor realities, and other limits reasonably necessary to protect the service and other users.
The current privacy and rights implementation is designed around a shared North America baseline for users in Canada and the United States, including California-specific notice and request handling where applicable. Availability in other regions may change, may be restricted, or may require additional controls before support is offered.
No software environment can guarantee perfect confidentiality, anonymity, or security. Your own actions, disclosure choices, device security, wallet practices, and account hygiene materially affect your privacy outcome. Public blockchain data, public-group activity, and user-shared information may be visible, linkable, or analyzable by third parties outside The Platform, and The Platform cannot make inherently public systems private.
Email, Electronic Communications, and Notices
By creating an account, using Cubitflow, or continuing to use The Platform, you agree that The Platform may send you platform updates, account notices, service notices, authentication notices, password-reset messages, security alerts, compliance notices, and other operational or relationship communications by email or other electronic means associated with your account.
You are responsible for keeping your email address and related contact information current and accessible. You accept the risk that delayed, filtered, lost, compromised, or inaccessible email accounts may interfere with your ability to receive account, security, or service notices, and that risk remains with you.
This agreement is intended to cover platform, account, security, relationship, and service-update communications. If applicable law grants you non-waivable consent or opt-out rights for specific categories of commercial or marketing messages, those rights continue to apply to the extent required by applicable law.
Wallet Tools, Non-Custodial Boundaries, and Transaction Responsibility
Cubitflow includes non-custodial software tools that help you interact with supported digital asset networks. The Platform provides software interfaces and utilities only. The Platform does not take custody of your digital assets, hold your private keys for you as part of normal product use, guarantee any transaction outcome, or act as your fiduciary, broker, custodian, escrow agent, money transmitter, or financial adviser.
You are solely and entirely responsible for wallet creation, vault setup, recovery phrase and private-key custody, backup creation, password management, device security, address verification, destination-tag or memo verification, network selection, amount selection, fee review, transaction approval, and all other wallet and transaction decisions. If you lose recovery material, lose access to your device, expose credentials, approve the wrong transaction, or send assets to the wrong address, tag, network, or recipient, you bear the entire risk of loss.
Before using any wallet tool, you must independently verify the destination, network, amount, fees, confirmations, asset compatibility, timing, ledger or chain conditions, and any other transaction details. Blockchain transactions may be delayed, rejected, re-ordered, or become irreversible, and third-party network conditions are outside our control.
User Agreements and Disclosures
You acknowledge and agree that Cubitflow is provided as software on an as-is and as-available basis and that feature behavior, performance, availability, or compatibility may vary by browser, device, jurisdiction, network, or third-party environment. You agree that the practical risks of public groups, messaging exposure, wallet usage, irreversible transfers, provider outages, data exposure, service degradation, feature changes, or account compromise are risks you choose to accept by using The Platform.
- You must maintain your own privacy, operational security, and wallet-security practices.
- You must not use The Platform for unlawful, fraudulent, abusive, exploitative, deceptive, or harmful conduct.
- You must not tamper with, exploit, probe, scrape, reverse engineer, abuse, or interfere with The Platform or other users except where non-waivable law clearly permits it.
- You accept that public groups, public blockchain activity, and user-controlled sharing may expose information beyond the audience you expect.
- You accept that external email, browser, notification, indexer, pricing, hosting, and blockchain systems may fail, degrade, delay, or behave unpredictably.
By using Cubitflow, you acknowledge that the consequences of your own security choices, disclosure choices, transaction choices, device-management choices, and lawful-use decisions remain your responsibility and not the responsibility of The Platform.
Third-Party Services, Networks, and Public Systems
Cubitflow may rely on or interact with third-party email providers, notification systems, browser or device platforms, hosting providers, indexers, pricing services, blockchain networks, wallet-related dependencies, or other external services. The Platform does not control those third parties and is not responsible for their legality, availability, security, compatibility, performance, or behavior.
Your use of third-party services, blockchain networks, browsers, devices, and infrastructure providers is at your own risk and may be subject to separate terms, fees, policies, and legal obligations imposed by those third parties.
No Advice, As-Is Service, and Disclaimer of Warranties
Cubitflow is software. Nothing provided through Cubitflow is legal advice, tax advice, accounting advice, investment advice, brokerage advice, custody advice, compliance advice, cybersecurity advice, or any other professional advice. Any information presented through The Platform is for general informational purposes only.
You are solely responsible for determining whether your use of Cubitflow and any messaging, wallet, or digital-asset activity is appropriate, lawful, and suitable for your circumstances. You should obtain independent advice from qualified professionals where needed.
To the fullest extent permitted by applicable law, The Platform and all related software, tools, and features are provided on an as-is and as-available basis, without representation, warranty, or guarantee of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, quiet enjoyment, or warranties arising from course of dealing or usage of trade.
- We do not guarantee uninterrupted access, uptime, continuity, or compatibility.
- We do not guarantee successful message delivery, notification delivery, wallet behavior, transaction confirmation, or external data accuracy.
- We do not guarantee that data will not be lost, delayed, exposed, corrupted, or rendered inaccessible.
- We do not guarantee that defects will be corrected or that external providers or networks will remain available.
Assumption of Risk, Limitation of Liability, and Release
You knowingly and voluntarily assume all risk arising out of your use of Cubitflow, including risks associated with your account, messaging decisions, privacy choices, public-group participation, wallet configuration, recovery-phrase handling, transaction approval, device security, email security, and use of public or third-party systems.
To the fullest extent permitted by applicable law, you agree not to hold responsible, accuse as blameworthy, assert claims against, or seek recovery from The Platform or its operators, owners, developers, contributors, affiliates, personnel, contractors, licensors, or service providers for losses, liabilities, damages, or consequences arising out of or relating to your use or misuse of Cubitflow, including losses caused by user error, exposed credentials, exposed recovery phrases, compromised devices, failed backups, wallet misconfiguration, irreversible transactions, public-group exposure, unlawful use, third-party misconduct, outages, degraded service, delayed notices, or external system failure.
To the fullest extent permitted by applicable law, The Platform and the persons and entities listed above will not be liable for any indirect, incidental, consequential, exemplary, special, punitive, or enhanced damages, or for any loss of profits, revenue, business, goodwill, opportunities, data, digital assets, or reputation, whether asserted in contract, tort, negligence, strict liability, statute, or any other legal theory.
Where applicable law does not permit a complete exclusion or limitation, the limitation and release in this section will apply to the maximum extent permitted by that law and will not limit any non-waivable rights that applicable law expressly preserves for you.
Indemnity
You agree to defend, indemnify, and hold harmless The Platform and its operators, owners, developers, contributors, affiliates, personnel, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, judgments, fines, penalties, and costs, including reasonable legal fees, arising out of or relating to your use of Cubitflow, your content, your wallet activity, your transaction activity, your violation of this legal document, your violation of applicable law, or your violation of any third-party right.
Suspension, Restriction, Termination, and Service Changes
The Platform may suspend, restrict, remove access to, modify, degrade, discontinue, or terminate all or part of Cubitflow or your account at any time, with or without notice, where we believe it is reasonably necessary for security, legal compliance, enforcement, abuse prevention, maintenance, operational integrity, risk management, product evolution, or any other reason we determine to be appropriate.
Features may change, move, fail, be removed, be delayed, become unavailable, or perform differently across devices, browsers, jurisdictions, networks, and providers. The Platform has no obligation to maintain any particular feature set, compatibility profile, or delivery schedule.
Termination or suspension does not limit any rights or remedies available to The Platform. Provisions that by their nature should survive termination will survive, including provisions relating to risk allocation, privacy limitations, liability, indemnity, lawful use, and interpretation.
Changes Without Notice
The Platform may revise, replace, supplement, remove, or update any part of this combined legal document at any time, including the Terms of Service, Privacy Policy, User Agreements, and Disclosures, with or without advance notice.
When we revise this document, we may update the effective date and publish the revised version through Cubitflow. Your continued access to or use of Cubitflow after any revision is posted means you accept the updated legal agreement. If you do not agree to any revision, you must stop using Cubitflow immediately.
You are responsible for reviewing this page periodically for changes. The Platform is not responsible for losses or disputes arising from your failure to review updated legal terms.
User Acknowledgement
By accessing or continuing to use Cubitflow, you acknowledge that you understand this combined legal document, accept the product limitations and risk allocations described in it, agree to maintain responsibility for your own lawful conduct, wallet custody, account and device security, privacy choices, and transaction verification, and agree that The Platform, its developers, and its contributors are not assuming those responsibilities for you.
